Misdemeanor/Traffic Prosecution

DUI's, Harassment, Third Degree Assault, and Domestic Violence
are examples of
crimes that fall into county court because they are misdemeanors. Misdemeanors
are punishable by fines and/or a sentence to the county jail. Felonies, by
contrast, are more serious crimes and are punishable by fines and/or a sentence
to the Department of Corrections (prison).
The Fremont County Court is a busy
court. Last year, 1109 misdemeanors, including
171 domestic violence cases were filed. In 2005, 1627 traffic cases,
including 353 DUI's were filed. That represents an increase of about 100
more DUI's in 2004. Additionally, there were just over 1600
traffic infractions and small claims cases filed. Our office does not
handle those cases because they are civil cases, not criminal cases.
