THE "MAP" PROGRAM
The Fremont Drug Court operates in some respects like other drug courts in the United States in that it imposes direct judicial supervision on defendants. This means that in addition to a requirement for reporting to a drug treatment agency for group and individual sessions and for random urinalysis (UA's), they must return to court on a regular basis to have their progress reviewed.
Here is how "drug court" or The Monitoring and Assessment Program (MAP) works. The Court calls defendants to the podium one by one and reviews the reports from the Drug Court Coordinator, Jack Davis, of a defendant's compliance or non-compliance with treatment requirements. Hearings for violations are promptly scheduled within 48 hours to ensure timely sanctions and accountability. Positive UA's, altered drug patches, missed call-ins, missed group and individual treatment sessions are considered violations and the judge hears all such reported violations from the coordinator.
The first violation will result in a five day county jail sentence, with subsequent violations resulting in doubling the prior penalty. Repeated violations could result in the client's probationary sentence being revoked and re-sentenced to Community Corrections or prison.
On the average, approximately 50 people, including juveniles, are enrolled in MAP. For the period from October 1, 2001 through September 30, 2002, 44 people have successfully completed MAP. Over 140 separate sanctions have been imposed on participants.
MAP is divided into three 90-day phases. In phase I, participants must submit to at least two weekly random UA's, attend two weekly group drug treatment sessions, and meet one-on-one with his primary counselor each month.
In phase II, participants must submit to two weekly random UA's, attend one weekly group session, and continue to meet one-on-one with his primary counselor each month.
In phase III, participants continue to submit to two weekly random UA's, attend one bi-weekly group session, and meet one-on-one with his primary counselor each month.
All UA's are random and the client must call the MAP coordinator daily.
